Terms of Use

These Terms of Use govern your access to and use of vorika.app, the Vorika application, and related features and services (together, Vorika or the Service).

The Service is provided by:

Vorika LLC (შპს ვორიკა)
Company identification number: 404828576
Registered address: 19 Erekle Tatishvili Street, Entrance 2, Basement Level, Mtatsminda District, Tbilisi, Georgia
Email: support@vorika.app

In these Terms, Vorika, we, us, and our refer to Vorika LLC.

By creating an account, purchasing a subscription, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What Vorika is

Vorika is a digital service for learning and practising English.

The Service may include:

  • conversations with an AI tutor;
  • speech recognition and speech analysis;
  • correction of language mistakes;
  • grammar and vocabulary explanations;
  • practice dialogues;
  • vocabulary cards;
  • spaced-repetition exercises;
  • language exercises and trainers;
  • personalised learning materials;
  • other features designed to support English learning.

We may add, change, improve, or remove features over time, subject to applicable law and the rights of users with an active paid subscription.

2. Artificial intelligence

Some Vorika features use artificial intelligence, speech-recognition technology, and other automated systems.

When you interact directly with an AI-powered tutor or another AI system in Vorika, the product interface will make clear that you are interacting with AI where required by applicable law.

AI-generated responses may contain errors, misunderstand context, misrecognise speech, or suggest wording that is not ideal in every situation.

Vorika is intended for language learning and practice. AI-generated content should not be relied on as legal, medical, financial, or other professional advice.

We may use AI tools to assist with the preparation of educational or editorial materials. Where materials are reviewed or edited by people acting on behalf of Vorika, Vorika remains responsible for the publication of those materials.

3. Who may use Vorika

You may use Vorika if you have the legal capacity to enter into an agreement under the law that applies to you.

If you are under the age at which you may enter into this agreement independently, you may use paid features only with the permission of a parent or legal guardian where such permission is required by law.

By purchasing a subscription, you confirm that you are authorised to enter into the purchase and to use the selected payment method.

4. Your account

Some features may require an account.

You agree to:

  • provide accurate information;
  • keep your login credentials secure;
  • not share your account in order to bypass subscription or usage limits;
  • contact us if you become aware of unauthorised access to your account.

You are responsible for activity carried out through your account to the extent permitted by applicable law.

We may temporarily restrict access where we reasonably believe that an account has been compromised, is being used in breach of these Terms, or creates a security risk.

5. Free and paid features

Some Vorika features may be available free of charge. Other features may require a paid subscription.

Before you complete a purchase, we will provide the information required by applicable consumer law, including the price, billing period, main features, automatic-renewal terms, trial conditions where applicable, and any taxes or additional charges that must be disclosed.

The price shown at checkout applies to that purchase.

6. Subscriptions and automatic renewal

Vorika may offer monthly, annual, or other subscription plans.

If a subscription is described as automatically renewing, it will renew for the stated billing period until you cancel it.

The applicable subscription price will be charged using the payment method selected at checkout.

You can cancel automatic renewal through your Vorika account where that option is available, or through the platform where you purchased the subscription.

Unless applicable law or the terms of a specific offer provide otherwise, cancellation stops future renewals and your paid access remains available until the end of the period you have already paid for.

Cancelling a subscription does not by itself create a right to a refund for a period that has already been paid for. This does not affect any statutory right to withdraw, terminate the contract, obtain a price reduction, or receive a refund.

7. Trials and promotional offers

Vorika may offer free trials, discounted trials, promotional prices, or special offers.

The duration, price, renewal terms, eligibility requirements, and any conditions for keeping a promotional price will be shown before you accept the offer.

If a trial converts automatically into a paid subscription, we will tell you this before you start the trial and show the price that will apply.

A promotional price may cease to apply if you cancel a subscription and later subscribe again, unless the terms of the offer state otherwise.

8. Price changes

We may change subscription prices for future billing periods.

A price change will not apply retroactively to a period you have already paid for.

Where required by law, we will notify you in advance of a change that affects an automatically renewing subscription. If you do not agree with the new price, you may cancel before the next renewal.

Any specific price guarantee included in an offer will continue to apply according to the terms of that offer.

9. Right of withdrawal for EU consumers

If you are a consumer in the European Union, you generally have a statutory right to withdraw from a distance contract within 14 days without giving a reason, subject to the exceptions and conditions provided by applicable law.

For a contract for services, the withdrawal period generally runs for 14 days from the date the contract is concluded.

If you ask us to begin providing a service during the withdrawal period, you may be required, where permitted by law, to pay an amount proportionate to the service supplied before you informed us of your decision to withdraw.

Different statutory rules may apply to digital content that is not supplied on a tangible medium. Where the law allows the right of withdrawal to be lost after supply begins, we will treat that right as lost only if the legal requirements for doing so have been met, including any required prior express consent and acknowledgement.

Nothing in these Terms limits a right of withdrawal or other consumer right that cannot lawfully be excluded.

To exercise a right of withdrawal in relation to a purchase made directly from Vorika, contact support@vorika.app with a clear statement that you wish to withdraw from the contract.

10. Digital-service conformity and statutory remedies

If you are an EU consumer, applicable law may give you specific rights where a paid digital service is not supplied, does not work as agreed, or otherwise fails to conform to the contract.

Depending on the circumstances, these rights may include:

  • having the Service brought into conformity within a reasonable time and without charge;
  • receiving a proportionate price reduction;
  • terminating the contract;
  • receiving a refund where required by law.

Nothing in these Terms removes or reduces these statutory remedies.

11. Purchases through Apple App Store, Google Play, or other platforms

If you purchase a subscription through Apple App Store, Google Play, or another third-party platform, that platform may handle billing, subscription management, cancellation, and some refund requests.

Its terms may apply in addition to these Terms.

Mandatory consumer rights continue to apply regardless of the platform used for payment.

12. User content

When using Vorika, you may submit or create content such as:

  • text;
  • voice recordings;
  • answers to exercises;
  • messages;
  • your own examples;
  • other information needed to use the Service.

You retain your rights in content that belongs to you.

You grant Vorika a limited, non-exclusive right to process that content only to the extent reasonably necessary to:

  • provide the Service;
  • recognise and analyse speech;
  • correct language mistakes;
  • generate your learning materials;
  • maintain security;
  • investigate technical problems;
  • improve the Service in accordance with our Privacy Policy and applicable law.

Personal data, including voice data where it constitutes personal data, is handled in accordance with the Vorika Privacy Policy and applicable data-protection law.

13. Acceptable use

You must not:

  • use Vorika for unlawful purposes;
  • attempt to access another user’s account without permission;
  • interfere with our servers, APIs, security systems, or technical infrastructure;
  • introduce malware or other harmful code;
  • scrape or extract the Service or its learning database at scale without our permission;
  • use automated tools to create artificial load on the Service;
  • bypass subscription, access, or technical restrictions;
  • reverse engineer or attempt to obtain source code except where applicable law expressly allows this;
  • use the Service in a way that infringes the rights of others;
  • use payment details without authorisation.

We may restrict or suspend access for a serious or repeated breach of these Terms. Where appropriate and legally required, we will give notice and a reasonable opportunity to remedy the breach.

14. Intellectual property

The Vorika website and application, software, interface, logo, Vorika character, illustrations, original exercises, learning-material structure, and other original elements of the Service are owned by Vorika or used under licence.

Your subscription gives you a limited right to use the Service for your own personal purposes. It does not transfer ownership of the software, designs, trademarks, characters, or learning materials.

Reasonable use of small extracts for personal study is permitted. Commercial copying, resale, systematic extraction, or mass redistribution is not permitted without the rights holder’s permission.

15. Third-party services

Vorika may depend on third-party services, including:

  • payment processors;
  • cloud infrastructure;
  • AI services;
  • speech recognition and speech synthesis providers;
  • analytics tools;
  • authentication services;
  • mobile application stores.

These services may be governed by their own terms and privacy policies.

We take reasonable care when selecting service providers, but some interruptions or failures may arise from systems outside our control.

16. Availability and changes to the Service

We aim to keep Vorika available and working reliably, but temporary interruptions may occur because of maintenance, updates, security work, technical failures, or third-party outages.

Where a change to a digital service supplied over time negatively affects an EU consumer’s access to or use of that service beyond what is minor, the consumer may have statutory rights, including a right to terminate in circumstances provided by applicable law.

Nothing in this section limits mandatory rights relating to the supply, conformity, or modification of digital services.

17. Learning outcomes

Vorika is designed to support English learning and practice.

Results vary depending on factors such as the learner’s starting level, study frequency, amount of practice, and individual circumstances.

We do not guarantee a particular language level, exam result, job offer, interview result, or other specific outcome.

This does not affect our obligation to provide a paid digital service in conformity with the contract and applicable law.

18. Limitation of liability

To the maximum extent permitted by applicable law, Vorika is not liable for indirect or consequential losses arising solely from the use of, or inability to use, the Service.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, these Terms do not exclude or restrict mandatory consumer rights, liability for fraud or intentional misconduct, or any other liability that cannot lawfully be excluded or limited.

19. Ending your use of Vorika

You may stop using Vorika at any time.

You may delete your account using the available account tools or by following the process described in our Privacy Policy.

Deleting your Vorika account does not necessarily cancel a subscription purchased through Apple App Store, Google Play, or another third-party platform. You must cancel such a subscription through the relevant platform.

If we discontinue a paid feature or the Service in a way that affects an already paid period, you will retain any remedies required by applicable law.

20. Changes to these Terms

We may update these Terms when reasonably necessary, for example because of:

  • new or changed features;
  • changes to payment methods;
  • legal or regulatory changes;
  • security requirements;
  • changes to our technical infrastructure.

If a change materially affects your rights or an active paid subscription, we will provide notice where required by law.

Changes to these Terms do not remove mandatory rights that already apply to you.

21. Privacy

Our processing of personal data is governed by the Vorika Privacy Policy.

The Privacy Policy explains, among other things, what data we collect, why we use it, how long we keep it, who may receive it, how voice data is handled, and what rights you have.

22. Governing law and EU consumer rights

These Terms are governed by the laws of Georgia to the extent that such a choice is permitted.

If you are a consumer in the European Union and mandatory consumer-protection rules of the country where you habitually reside apply to your contract, the choice of Georgian law does not deprive you of the protection provided by those mandatory rules.

Nothing in these Terms prevents you from bringing a claim before a court or using another dispute-resolution mechanism available to you under mandatory applicable law.

Before starting formal proceedings, you may contact us at support@vorika.app so that we can try to resolve the matter directly.

23. Language

These Terms may be made available in more than one language.

The English version is our reference version. However, this does not override any mandatory consumer-protection rule, language requirement, or interpretation rule that applies under the law of your country.
